Terms of Service

1. Acceptance
By creating an account, you agree to be bound by these terms. If you are using Quark9 on behalf of an organisation, you confirm you have authority to bind that organisation.
2. Subscription & billing
Plans are billed monthly or annually as selected. Fees are non-refundable except where required by law. Usage in excess of plan limits is billed at the standard overage rate.
3. Acceptable use
You agree not to (a) use Quark9 to discriminate unlawfully, (b) attempt to reverse-engineer the platform, (c) abuse rate limits, or (d) upload malware. Violations may result in suspension.
4. Candidate fairness
Quark9 surfaces scores and rationales, but you are responsible for the final hiring decision. You agree to use the platform consistent with applicable employment laws, including EEOC, GDPR Article 22, and India's DPDP requirements.
5. Service availability
Enterprise plans include a 99.9% uptime SLA. Scheduled maintenance is announced 72 hours in advance. We are not liable for outages caused by third-party infrastructure (AWS, Google Cloud).
6. Termination
Either party may terminate with 30 days' written notice. Upon termination, you may export your data for 30 days, after which it is permanently deleted.
7. Liability
Quark9's aggregate liability is capped at fees paid in the 12 months preceding the claim. We disclaim consequential damages to the extent permitted.
8. Governing law
These terms are governed by the laws of Uttar Pradesh, India. Disputes will be resolved in Noida.
